Never Be Soft is a brand of Lehr Ventures LLC ("we", "us"). This policy explains what we collect when you visit neverbesoft.com or buy The Comeback, why we collect it, and what we do with it. If anything here is unclear, write to danny@neverbesoft.com and a human will answer.

What we collect

  • Your email address and first name, when you enter them to request a free workout or when you buy.
  • Purchase information, when you buy. Payment is processed by Stripe. We receive your email, your name, the amount, and whether the payment succeeded. We never receive or store your full card number. Stripe handles card data directly and we have no access to it.
  • Replies you send us, including anything you choose to tell us about your training, your progress or your health. You decide what to share. Please do not send us medical records.
  • Basic technical information that any web server receives, such as your IP address, browser type and the pages you requested. We use this to keep the site working and secure.

What we do with it

  • Deliver the program you signed up for, which is email based.
  • Answer you when you reply.
  • Send you related coaching email. You can unsubscribe from any of it at any time using the link in any email, or by replying and asking.
  • Understand, in aggregate, how many people visit and sign up so we know whether our advertising is working.

Who else touches your data

We keep the list of companies short on purpose. The ones that handle your information are:

  • Stripe for payment processing and billing.
  • SendFox for sending and managing email.
  • Cloudflare for hosting and serving this website.
  • Google for our own business email.

Each of these has its own privacy policy governing what it does with data. We do not sell your personal information, we do not rent it, and we do not share it with data brokers.

Advertising

We advertise on Meta platforms. If we run advertising measurement on this site, it may set cookies or similar identifiers that let Meta attribute a signup or a purchase to an ad you saw. We do not send Meta the contents of your replies or anything you tell us about your health. You can limit ad tracking in your browser settings and in your Meta account settings.

Health information

Never Be Soft is a fitness program, not a healthcare provider, and we are not a HIPAA covered entity. We do not ask for your diagnosis, your prescriptions or your medical history, and we would rather you did not send them. Anything you volunteer in a reply is treated as confidential and is not shared or sold.

How long we keep it

We keep your email address until you unsubscribe or ask us to delete it. We keep purchase records for as long as tax and accounting law requires, which is generally seven years.

Your choices

  • Unsubscribe from any email using the link at the bottom of it.
  • Ask us what we hold about you, and we will tell you.
  • Ask us to delete it, and we will, except for records we are legally required to retain.
  • If you are in California, the CCPA gives you these rights explicitly, and we honour them for everyone regardless of where they live.

Children

This site and this program are for adults. We do not knowingly collect information from anyone under 18.

Security

The site is served over HTTPS. Payment credentials never reach our servers. Our credentials for the services above are stored encrypted. No system is perfect, and we will tell you promptly if something happens that affects your information.

Changes

If we change this policy we will update the date at the top. Material changes will be sent to subscribers by email.
